Kolkata, Dec 14 – The West Bengal Government on Wednesday moved to a double bench of Calcutta High Court challenging its single bench order asking the Kolkata Police to refrain from any action against some opposition BJP legislators till January 17 for allegedly disrespecting the National Anthem in the state Assembly.


The single bench judge, Justice Jay Sengupta on December 7 had stayed any probe till January 17 next year into the alleged disrespect shown to the National Anthem by eight BJP MLAs.
The state government, however, on Wednesday, moved the double bench headed by Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharya challenging the order.


Ruling Trinamool Congress legislators alleged the opposition BJP MLAs have disrespected the National Anthem when they were singing on the floor of the house.
The FIR was filed after the TMC charged the BJP legislators with shouting anti-state government slogans and not standing up while the anthem was being sung as both the ruling and opposition MLAs were holding sit-in protests on different issues on November 29 in the Assembly.
